Acceptable Usage Policy (For Avanti Services) Consumer Packages
Acceptable Usage Policy (AUP) protects you against users who might abuse the shared nature of the service. While bandwidth is shared fairly at any one time, it is at peak hours when this becomes more critical. To ensure fairness and clarity, Avanti have set up a data volume system based on the service you have contracted and the average usage on the network. As we will contact any user who reaches 80% of their data volume limit for the month to discuss ways to help them use the service more fairly. This can be via an upgrade of service, changing usage patterns or how data is sent. Avanti will apply a throttle on the service provided to the end of any month if a terminal exceeds the monthly data volume limit. Our experience is that most customers do not exceed the AUP limits and those that do mostly adhere to any agreed changes. This helps to make or services satisfactory to all our subscribers. Acceptable Usage Policy - Frequently Asked Questions
Below you should find answers to frequently asked questions regarding the ACL Acceptable Usage Policy – or AUP for short.
What Is The Usage And Contract Term
ACL Telco offer a standard service on a twelve month rolling contract, ACL require 30 days notice of termination of contract, should a notice of termination be received from a client ACL will calculate the charges remaining to end the 12 month contract and raise an invoice accordingly, this invoice will contain the charges including loss of revenue relating to the remainder of the standard ACL contract.
ACL reserve the right to end a contract after the first 30 days of service, the end user will be given notice by ACL allowing sufficient time for the end user to find another service provider. ACL's statndard notice period will be 30 days however from time to time this may be changed taking in to consideration the circumstances relating to the termination of contract.
Should a termination notice be issued by ACL, ACL will undertake to provide contact information relating to possible Avanti Communications PLC Suppliers allowing for a smooth migration to another supplier.
Should ACL decide to issue Notice to end a standard contract or have intentions to suspend service ACL will either email the contracted client or advise the client by post. Any emails advising clients of suspension or intention to end contract will be sent by the ACL service provision team.
At no point do ACL Guarantee to continue with service provision beyond the first thirty days of a standard contract, the standard contract is applied to all equipment supplied under the Welsh Government grant applications. From time to time ACL may consider automatic assignment to another supplier or to terminate the standard contract. As the service is provided by a third party (Avanti Communications PLC) ACL will not be responsible for the actions of the third party, should the contract between the third party and ACL come to an end the third party may choose to cease or migrate the service regardless of duration, contract or comencement dates. Any migration that the third party may choose to make may be done so with a higher monthly usage charge / cost than that of the ACL tariffs. ACL under no circumstances will be liable for the provision of ongoing service, nor will ACL compensate for the actions of the third party supplier. ACL will bill and collect on behalf of the third Party. Should the third party choose to migrate your services on a given date with or without your consent, from the day of migration or splash page apearance ACL will cease to bill from this date forward, any rentals owing or due before the date of migration will be collected, failiure to pay outstanding rentals will result in collection proceedings being brought against the 30 day contracted customer by ACL Telco Ltd.
Contracts other than our standard contracts and terms and conditions are available, these contracts include free equipment and services and will normally run for multiple years, all non standard contracts are signed by by both the end user and a representative of ACL.

What is the Acceptable Usage Policy (AUP)?
As part of our commitment to providing our customers with excellent quality, faster downloads and more reliable service, ACL have an Acceptable Usage Policy on our broadband services. The Acceptable Usage Policy (or AUP as it is referred to here) is a usage guideline for our users that ensures all users have reasonable access to network capacity.
Why has the AUP been implemented?
Whilst ACL encourages users to take advantage of our broadband service, we have an obligation to ensure that all users have fair access to network resources to receive the best possible service at all times.
Every user is different in how they use their ACL service, and we here at ACL respect that. A very small number of our users however consume a disproportionally large amount of our network resources. By restricting the speed of these users once they ready their acceptable usage limit ACL can ensure that they continue to provide an acceptable standard of service to all users.
How does the AUP apply to me?
ACL continually monitor the total amount of data you have download and uploaded during the calendar month. In the event that you exceed 80 % of the AUP limit for the month on your service plan ACL will send you a friendly reminder via email. If you are near the end of the calendar month or otherwise do not think you will exceed your usage limit for the month then there isn’t anything to worry about – your usage total will reset to zero at the end of the calendar month. If your online usage habits have changed then you can view a list of plans available at www.aclsatellitebroadband.co.uk Upgrading your service plan may be suitable if your online usage habits have changed, e.g. if you are downloading more files, viewing more online videos or otherwise using the Internet more often.
If you do not upgrade your usage plan and exceed your usage limit for the month then we will send you another email or a letter in the post if you have no contact email address informing you that you have exceeding your Acceptable Usage limit for the month and that your connection has been automatically limited to a lower speed for the remainder of the month. If you do not upgrade your usage plan then your service speed restrictions will be removed at the end of the current month and your usage total reset to zero.
What if I exceed my Acceptable Usage limit too often?
If you exceed your Acceptable Usage limit three consecutive months in a row, or three times within the last six months then you must upgrade your service. ACL reserve the right to terminate services as per the Terms and Conditions of your contract.
Or you can request that your service is placed onto a VBB service, this means that your service will not throttle and you will agree prior to the VBB being implemented that you will pay the excess usage costs. (Definition of VBB Volume Based Billing).
What counts towards your Acceptable Usage limit?
Your monthly usage totals include both uploading and downloading on your ACL’s service. All usage is measured in Megabytes (MB), one Megabyte being roughly one million bytes. Our online usage checker displays your usage total in Gigabyes (GB), each Gigabyte being roughly one thousand Megabytes we have provided a table below showing rough guidelines for how much each usage example consumes.
Viewing a web page 0.2 MB
Uploading a picture to Facebook 0.2 MB
Downloading an email (no attachments) 0.01 MB
Downloading an MP3 5 MB
Watching a two minute Youtube clip 3.75 MB
30 minutes of online radio 22 MB
1 hour of BBC iPlayer 280 MB
Downloading a movie 700 MB
Now For example if you:
Downloaded a movie 700 MB Viewed 200 web pages 40 MB Received 50 emails (with no attachments) 0.5 MB Watched 30 Youtube clips 113 MB Downloaded 20 MP3s 100 MB Your usage for the month would be approximately 953.5 MB, or 0.953 GB for the month.
These figures are only guides.
How Do I Check My Current Months Usage Total And AUP Limit ?
You can view your current monthly usage total and AUP limit online behind your satellite terminal any time at: http://portal.avantiplc.com. Please note that the online usage total is not updated in real time, it updates once every 24 hours. How can I prevent excessive or unwanted Internet usage?
1. Prevent or restrict access to your computer(s) and computer network:
2. Never share your computer password.
3. If using a WiFi network ensure that you are using WPA encryption with a encryption key which is not easy to guess (such as your name, pets name, etc). Visit your router manufactures website or see your documentation CD for details.
4. Install and regularly update antivirus software to minimise the risk of your connection being used by unauthorised users.
5. • Do not leave streaming radio or music running while you are away or otherwise not listening.
6. Popular peer-to-peer programs such as Bit Torrent, Limewire, eMule etc often enable unrestricted uploading of content by default. This is often invisible to users and you may not even be aware you are sending large quantities of data. Check your program preferences to ensure uploading is limited or disabled.
When is my service speed restriction removed if I have breached the AUP? Service speed restrictions due to AUP breaches are removed on the 1st of every month.
I am doing more things online now, can I upgrade up service plan so I do not breach the AUP limit each month?
If you find you are using the Internet more often, or your usage habits have simply changed you may find that upgrading your service plan is required to prevent you breaching your AUP limit frequently. You may view our available plans online at www.aclsatellitebroadband.co.uk and contact us to upgrade your service plan. Upgrading will also remove any service speed restrictions currently in place. If you upgrade your service plan in the middle of the month then we will automatically sort out the difference in pricing between your old service plan and new service plan for the remainder of the month. Please note that you may not downgrade service plans until the existing service plan has run for a full twelve months inline with our standard contract term or in the event of a non standard service contract term which could run for multiple years..
What else does the AUP cover?
The AUP also defines what you can and cannot use the service for, example such as sending spam email, attempting to access systems which you are not authorised to do so, abuse and/or violation of privacy, property or other rights of 3rd parties etc.
Migrating Clients From Another Supplier To ACL Telco Ltd Who Own Their Equipment
Any client who migrates from another supplier to ACL will be bound by a 30 day contract that requires 30 days notice on or before the last day of the first 30 days and any re curring subsequent 30 days beyond the first 30 days.
the maximum term from day one is 60 days including the 30 days notice to leave or cease service with ACL.
Packages, Tarriffs and Prices
ACL reserve the right to increase or reduce the costs at any point, ACL will endevour to give suitable notice of any such changes, in most cases the notification will be two months prior to the increase.
ACL will attempt to hold prices down however market pressures and changes in exchange rates may result in increases.
FUP For Europe Home Packages
The Europe Home group of packaeges launched in 2014 are built to give higher monthly data to consumers, the packae will run at the headline speed until 20% of the alloted monthly data has been used, then the headline speed will drop by 20%.
This reduction of headline speed will continue through the month in 20% increments until either the alloted data has been used or the aniversary date of the service in the month arrives.
The headine speed is indicative only, from time to time the headline speeds will fluctuate and during peak times the service maybe slower than normal.
speed tests can be carried out by connecting a PC directly to the White Hughes Terminal with a CAT 5 lead and running a speed test at http://portal.avantiplc.com, you cannot run speed tests from any other speed tester as they do not have the abillity to cope with the extended PING latency that you get with satellite broadband.
The FUP applied to Europe Home packages is there to ensure fair usage by all.
Avanti Satellite Broadband packages are not suitable for:
Although there’s nothing technically to stop you connecting to your companies corporate VPN with Avanti there are some things you need to understand.Check with your IT department at work and find out if your company’s VPN is an IPSec type of VPN.
If it is, these often require a static, public IP address to function.
Static IP addresses are only provided on our Avanti Pro products.
The AUP policy is provided above before this Frequently Asked Questions section. ACL may update this document from time to time.
By using the ACL service you agree to all the terms and policies of this document.
ACL will under no circumstances accept claims for compensation for poor or disconnected service of the satellite broadband.
From time To time ACL will reserve the right to change the terms and conditions of use inline with leagal requirements.
